How it works:

Enroll: Create an EagerGear customer account and you are automatically enrolled in our EagerGear Member Rewards program. You will enter your first name, last name and email address. Your email address is your username and you will create a password. That’s it! You may enter additional info like billing and shipping address to save yourself a few steps when you place your order at EagerGear.

Earn: For every purchase you make at EagerGear, you’ll earn 1 point for every $15 you spend to use on future purchases. 1 point = $1 for future purchases. There is a minimum of 5 points required to apply to your future purchase.

Track: Log into your EagerGear account to see how many points you have available to use.

Expire: EagerGear Member Rewards points expire six (6) months after they are earned.

Terms and Conditions:

The EagerGear Rewards Program (“Program”) is offered to you by EagerGear LLC (“EagerGear”). EagerGear may at any time in its sole discretion alter, modify or terminate the Program and/or these terms and conditions without further benefits and/or obligations to members. Should we decide to terminate, alter or modify the Program or these terms and conditions, EagerGear will provide you written notice via email or a notice posted on www.eagergear.com. These Terms and Conditions may be amended from time to time without written or posted notice to members. Terms and conditions are void where and to the extend prohibited by law.

Who May Enroll in EagerGear Member Rewards:

There is no purchase necessary to join EagerGear Member Rewards. Membership in this program is open to legal residents of the 50 United States, The District of Columbia (“D.C.”), Puerto Ricao and Canada (excluding Quebec) who are 18 years or older at the time of membership enrollment. By enrolling in the EagerGear Member Rewards program, you represent that are you 18 years of age or older and you agree to these terms and conditions. Membership (and rewards earned from membership) are nontransferable. Void where prohibited. EagerGear employees and their domestic partners/spouses are not eligible to participate in the EagerGear Rewards Program.

How to Enroll in EagerGear Member Rewards:

Joining the EagerGear Member Rewards Program is easy. You must provide your first name, last name and email address to join. EagerGear encourages you to provide valid billing and shipping address to your account.

How to Earn Points in the EagerGear Member Rewards Program:

Points are earned at the time of purchase. Members of the Program earn one (1) point for every $1 US Dollar spent on qualifying purchases, not including Excluded Items. EagerGear, from time to time, may provide promotions or special offers where members may earn additional points. For online purchases, you must be logged into your EagerGear account and not check out as a guest.

Excluded items include Gift Card Purchases and Monthly Club. Qualifying purchases do not include sales tax or shipping. Points cannot be redeemed for excluded items. EagerGear may add or delete Excluded Items at any time in its sole discretion.

Points will be deducted from your EagerGear Member Rewards account when products are returned or exchanged. EagerGear will deduct rewards from your account in the amount of the returned item or the difference of the exchanged product (if the new item is less than the original item) net of taxes. If products are subject to a price adjustment, points will be deducted from your EagerGear Member Rewards account for the incremental amount of the price adjustment net of taxes. EagerGear does not award points for purchases made prior to joining the program and the start of the program.

Points can only be earned for products intended for personal use. EagerGear does not allow points to be earned under the program for products purchased for resale purposes. Points earned for purchase of EagerGear items for resale purchases are a violation of the terms and conditions and subject to termination in the program and/or removal of all points earned at the sole discretion of EagerGear.

How to Redeem Rewards:

For every 5 points you earn in the EagerGear Rewards Program, you may redeem those points for $5 discount off of a future qualifying purchase at www.eagergear.com. There is a minimum of 5 points required to receive a discount.

When Rewards Points Expire:

Reward points expire six (6) months from the date they are issued, unless noted otherwise.

General Terms:

Membership points have no cash value and are nontransferable. EagerGear is not responsible for communication errors including reward notifications due to change of email address or other changes in contact information. Other exclusions or restrictions may apply.

In all matters relating to the administration of the Program, the decisions of EagerGear are final. EagerGear reserves the right to cancel, amend or revoke any program, including, without limitation, the Program, at any time due to reasonable business consideration or circumstances beyond its control or as required by applicable law. In addition, EagerGear reserves the right to terminate your membership, and void any points accumulated in such account(s), if you, in EagerGear’s sole discretion, violate any of these terms and conditions or any applicable law, earn points via deception, forgery, fraud, or commit any other abuse of the Program.

Cancellation:

You may cancel your EagerGear Member Rewards account at any time by notifying EagerGear customer service via email or mail.

Privacy Policy and Communication:

By becoming a member of the Program, you agree to receive marketing materials, advertising and other communications from EagerGear. You may opt out of receiving communications from EagerGear by clicking “Unsubscribe” or “Opt Out” at the bottom of our e-mails. Please note, however, that by unsubscribing to EagerGear’s communication or by withdrawing consent some services EagerGear offers to you may become unavailable. Also note that removal from EagerGear’s contact list will not prevent you from receiving e-mail communications relating to any online purchase order you place with EagerGear or from receiving your rewards Certificates issued to you, subsequent to opting-out.

Limitation of Liability:

EAGERGEAR SHALL NOT BE LIABLE FOR ANY CLAIMS, ACTIONS, INJURY, LOSS OR DAMAGE OF ANY KIND, INCLUDING, WITHOUT LIMITATION, PERSONAL INJURY OR DEATH, RESULTING FROM THE EAGERGEAR REWARDS PROGRAM. THIS LIMITATION OF LIABILITY IS A COMPREHENSIVE LIMITATION OF LIABILITY THAT APPLIES TO ALL DAMAGES OF ANY KIND, INCLUDING, WITHOUT LIMITATION, COMPENSATORY, DIRECT, INDIRECT, OR CONSEQUENTIAL DAMAGES; LOSS OF DATA, INCOME, OR PROFIT; LOSS OR DAMAGE TO PROPERTY; AND CLAIMS OF THIRD PARTIES. YOU ACKNOWLEDGE AND AGREE THAT EAGERGEAR HAS NOT MADE AND IS NOT IN ANY MANNER RESPONSIBLE OR LIABLE FOR ANY WARRANTY, REPRESENTATION, OR GUARANTEE, STATUTORY, EXPRESS OR IMPLIED (INCLUDING, WITHOUT LIMITATION, THE IMPLIED WARRANTIES OF MERCHANTABILITY, TITLE, AND FITNESS FOR A PARTICULAR PURPOSE), IN FACT OR IN LAW, RELATIVE TO THE EAGERGEAR REWARDS PROGRAM. WITHOUT LIMITING THE GENERALITY OF THE FOREGOING, EAGERGEAR DOES NOT MAKE ANY EXPRESS OR IMPLIED WARRANTIES OR REPRESENTATIONS WITH RESPECT TO EAGERGEAR.COM OR ANY OTHER PARTICIPATING EAGERGEAR OWNED AND OPERATED WEBSITE(S) AND EAGERGEAR SHALL NOT BE LIABLE FOR THE CONSEQUENCES OF ANY INTERRUPTIONS OR ERRORS RELATED THERETO.

Governing Law:

These Terms and Conditions and the EAGERGEAR Member Rewards program will be interpreted, construed and enforced, and governed in all aspects in accordance with the exclusive jurisdiction and laws of the State of Delaware, United States of America. Any cause of action arising under or relating to these Terms and Conditions will be brought exclusively in a court in Delaware.
